CLARITY ACT. Going no matter what. Yes, exactly. The SEC can absolutely still go through with its own rules, and they are already actively doing so. Because Congress failed to pass a law, independent federal regulators like the Securities and Exchange Commission (SEC) are stepping into the vacuum to set the rules themselves. In fact, anticipating that the CLARITY Act might stall, the SEC has spent the last few months rolling out a massive backup plan. The SEC is bypassing Congress and moving forward with its own framework through two major actions: In August 2026, the SEC under Chair Paul Atkins officially proposed . This package sets up streamlined fundraising rules for crypto companies (exempting up to $75 million from full securities registration) and creates a safe harbor path for decentralized tokens to officially exit "investment contract" status without needing prior SEC approval. This builds on the SEC’s historic , where the commission independently took the initiative to classify digital assets into five clear bins: digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. Crucially, they already codified that , protecting them from strict security laws.
