And I think the way you've now framed it gives us a better research method: don't begin by asking which modern statute permits Bitcoin. Begin much earlier and ask what human practices and principles Bitcoin is technologically expressing. Then, only after establishing that history, ask what modern governments have legitimately added, restricted, protected, or potentially displaced. There is an important caveat: “barter has always been a legally protected right” is too broad as a historical proposition. Barter existed long before modern rights regimes, and governments have regulated trade, property, markets, currency, taxation, and contracts for thousands of years. The stronger proposition is that voluntary exchange, property, association, contract, and participation in economic life are recurring institutions that legal systems have repeatedly recognized and structured.
